This promotion is run by Amka Products (Pty) Ltd (“Amka”) and concerns the Clere Radiance for Even Tone skin products. Amka claims that if a participant with normal to oily skin purchases and uses all four products in the Even Tone skincare range everyday for 7 consecutive days, the participant will experience visible results in the radiance of his/her facial skin tone in that his/her facial skin will have added hydration, be visibly smoother and have a natural glow. If the participant does not experience the aforesaid results, Amka will, subject to verification and compliance by the participant with these Terms and Conditions, refund (by way of vouchers) to the participant the amount paid by the participant for the products.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. By participating in the promotion all participants will be deemed to have accepted and be bound by these Terms and Conditions. Participants should retain a copy for their information.

Amka takes data protection seriously. By entering into this promotion and submitting any information required as part of a participant’s participation in the promotion, participants agree to their information being held and processed in accordance with the Protection of Personal Information Act 2013 (“POPIA”).

This promotion is open to participants in South Africa only, aged 18 years or over. This promotion is open to everyone, including Amka’s employees and their immediate families, its agents and anyone else professionally connected with this brand.

Participants are required to purchase all four of the Clere Radiance for Even Tone skin products at one time and use all four of the products every day for 7 consecutive days. The relevant products being:

Clere Radiance Even Tone Toner
Clere Radiance Even Tone All-in-One Day Cream
Clere Radiance Night Re-Newer

If, despite a participant having complied with the requirements of paragraph 5 above, a participant feels dissatisfied with the products after the 7-day period, he/she may submit a claim to Amka and request a refund of the amount paid for such products.

Subject to the other provisions of these Terms and Conditions, participants will only qualify for a refund after using the products as prescribed every day for the 7-day period.

The refund will be by way of a voucher and not cash.

Participants must notify Amka within 7 days of the expiry of the 7-day period of its claim and request a voucher, failing which the participant will not be entitled to claim any refund for the products. In order to request the refund, participants must:

contact the Amka consumer care line on 0860 002 642 or the consumer relation’s WhatsApp number on 060 996 6087;
nominate an address for collection of the products and Amka shall, at its cost, make the necessary arrangements to collect the products from the participant;
submit a photograph/s of the Even Tone products along with a picture of his/her purchase receipt (till slip) for the products to Amka Consumer Care line via WhatsApp to 060 996 6087;
submit any other information requested by Amka.

Amka shall attempt to collect the products from the participant’s nominated address once and should both attempts be unsuccessful then the participant’s claim for a refund shall become null and void.

Upon receipt of the returned products, Amka’s dedicated consumer care team shall assess the refund request and compliance with these Terms and Conditions, which shall include but not be limited to Amka verifying that the products have been purchased within the relevant period (see paragraph 9 above) and at least 50% of the contents of the returned products remain.

Amka shall notify a participant of its decision to refund or not within [3] days of receipt of the products and requested documentation and information. If the verification process is successful and all other requirements as set out in these Terms and Conditions have been complied with, Amka shall send the qualifying participant a voucher for the amount of the refund via SMS/ WhatsApp or email together with notification of its decision to refund the participant.

Vouchers will be redeemable at all Shoprite; Dischem; Pick n Pay stores nationwide or such other retail stores as Amka may select from time to time. This may not be the same retailer where product may have been brought from.

Amka reserves the right, at any time and at its sole discretion, to amend or withdraw this promotion without prior notice, for any reason whatsoever including but not limited to unforeseen circumstances outside its control.

Amka’s decision is final and binding in all matters and no correspondences will be entered into.

Amka may disqualify any participant who breaches these Terms and Conditions; or commits fraud or any other crime or acts in bad faith in any manner whatsoever. Amka shall be the final arbiter in any decisions.

Neither Amka nor its employees, directors, agents, distributors or representatives shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever which may be suffered by any participant in relation to this promotion.

If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

The promotion and these Terms and Conditions will be governed by the laws of South Africa and any disputes arising in respect of these Terms and Conditions will be subject to the exclusive jurisdiction of South African courts.

Complaints or questions concerning these Terms and Conditions and the promotion, as well as requests regarding the rights which participants may assert over their personal data, must be sent in writing to info@amka.co.za

Amka will not have any liability in the event that any participant provides incomplete or incorrect details to Amka.

The provisions of these Terms and Conditions shall be deemed to be qualified to the extent required in order to ensure compliance with the applicable provisions of the Consumer Protection Act, 68 of 2008 (“CPA”) and these Terms and Conditions must be interpreted and applied accordingly. This promotion will be conducted in accordance with the CPA. Should you qualify for a voucher, you undertake to expeditiously do all things necessary to enable Amka to comply with its obligations under the CPA.

By participating in this promotion and in accordance with POPIA, you consent to (i) the processing of your personal information by Amka, any of its operators, commercial partners, agents and subcontractors on the condition that they will keep such information confidential; (ii) the collection of your personal information from any other source to supplement the personal information which Amka has about you; (iii) the retention of your personal information for as long as permitted for legal, regulatory, fraud prevention and marketing purposes, only for the purposes of this promotion.
